owners of properties in Spain
can now have a Spanish will
drawn up and signed in
Ireland. In addition, the firm
is also offering a service
whereby a search on the
Spanish properties can be
carried out to establish first
of all that the owner is in
fact
registered as
owner and secondly, to
ascertain whether there are
any problems on the title
relating to planning
permissions or licensing etc.
It is essential for anyone who
owns a property in Spain that
they should have a Spanish
will covering that property.
Failure to have a Spanish
will, can lead to enormous
problems and delays with
regard to the administration
of estates.
The Spanish authorities will
follow the administrative
process of the country of
residence of the Spanish
property owner, but without a
Spanish will, the Spanish
authorities may require proof
that probate has been
extracted in Ireland and will
only recognise this in the
form of an Order of the High
Court. This can lead to
significant delay and
substantial costs being
incurred.
Tom McGrath & Associates have
set up a user friendly
procedure whereby their
clients are provided with a
questionnaire in order to
provide their instructions for
the making of their Spanish
will. Once the will has been
drawn up, the clients attend
before Tom McGrath, Notary
Public. Once the Wills have
been signed they are then
registered in Spain through
Tom McGrath & Associates’
legal representatives.

property industry in Spain,
